West Virginia Mechanic Lien Enforcement Deadlines

Private Works — 6-Month Suit Deadline

Under West Virginia law, a mechanic lien claimant must commence suit to enforce the mechanic lien within 6 months from the date the mechanic lien was filed. This enforcement period is measured from the filing date of the Notice of Mechanic Lien, not from the date of last furnishing.

The 6-month enforcement deadline is relatively short. Claimants should begin preparing for enforcement proceedings promptly after filing their mechanic lien to ensure all documentation is in order.

Public Works — Bond Claim Suit (Between 60 Days and 1 Year)

Under W. Va. Code §21-1C-1, suit on a public works payment bond may not be commenced earlier than 60 days after the date of last work performed, and must be filed no later than 1 year after the date last work was performed or materials were supplied.

The 60-day waiting period allows time for the general contractor to resolve the claim before litigation. However, claimants must not exceed the 1-year outer deadline.

Prerequisites for Enforcement

Before commencing a mechanic lien enforcement suit, claimants must verify that all prerequisite steps have been completed: (1) timely notice to owner (for subs/suppliers), (2) timely filing of the Notice of Mechanic Lien within 60 days, and (3) proper content in the mechanic lien filing.

Failure to comply with any prerequisite step may result in the mechanic lien being declared invalid, even if the enforcement suit is timely filed.
