This statutory framework provides Mechanic's Lien rights to contractors, subcontractors, and material suppliers who furnish labor or materials for the improvement of real property in the State of New Mexico.

New Mexico has different requirements for contractors and subcontractors. Contractors are not required to serve any preliminary notice and must record a Mechanic Lien Claim within 120 days after completion of the contract. Subcontractors and materialmen not in privity with the contractor must serve a Notice of Right to Claim a Mechanic Lien within 60 days of first furnishing if the claim exceeds $5,000. Pre-lien notices are not required on residential projects of 4 or fewer dwelling units.
