North Dakota Mechanic Lien Enforcement Deadlines

Private Works — 3-Year Suit Deadline

Under North Dakota law, suit to enforce the Mechanic's Lien must be filed within 3 years of recording the Notice of Intention to Claim a Mechanic Lien. This is one of the longest enforcement periods in the entire United States, providing claimants with substantial time to pursue foreclosure.

The 3-year clock begins from the date the Notice of Intention is recorded, not from the date of last furnishing or from the date the mechanic lien itself is filed. Claimants should carefully calendar this deadline upon recording.

Minimum Waiting Period Before Suit

Suit cannot be filed earlier than: (1) 10 days after personal service of the Notice of Intent, or (2) 20 days after service by registered mail, or (3) 30 days after a demand by the owner, agent, or contractor for a statement of account.

These minimum waiting periods ensure the property owner has adequate time to respond to the mechanic lien claim before litigation commences.

Public Works — 1-Year Suit Deadline (NDCC 48-02)

On North Dakota public works projects requiring 100% payment bonds under NDCC Chapter 48-02, all suits must be filed within 1 year after completion and acceptance of the project.

Claimants not in privity with the bond principal must have given notice within 90 days of completing their work under NDCC 48-01.2-11 as a prerequisite to filing suit.

No Mechanic Lien on Public Property

As with all states, North Dakota does not permit the filing of Mechanic's Liens on public property.
